Plaintiff asks for recusal of judge in beach closure lawsuit
In a motion filed on Tuesday, the plaintiff in the local beach closure lawsuit is asking that the judge assigned to the case recuse herself because of her close ties to the local Democrat party.
In the motion, William Rickertsen argues that it is impossible for Nueces County Judge Barbara Canales and the presiding judge in the case, The Honorable Judge Lisa Gonzales (County Court at Law 2) to not know each other. Rickertsen also argues that because of “political overtones” and local political ties, it would be impossible for Judge Gonzales to rule fairly in the case.
Rickertsen filed the lawsuits last week alleging that Nueces County Judge Barbara Canales and Corpus Christi Mayor Joe McComb conspired to commit a breach of contract when they closed down vehicle access to area beaches due what local political advocates claim is a health and safety issue.
In addition to Rickertsen’s lawsuit several other petitions have been circulating demanding that beach access be restored. A local group is also organizing a rally in support of reopening the beach on August 15 in front of City Hall.
